MusiKhan Terms of Service

Welcome to MusiKhan. These Terms of Service (“Terms”) govern your access to and use of MusiKhan, a blockchain-based music streaming platform where users stake LP tokens to unlock music content. By accessing or using MusiKhan (the “Platform”), you agree to be bound by these Terms. If you do not agree, you must not use the Platform. These Terms constitute a legal agreement between you (the “User” or “you”) and the MusiKhan service provider (“MusiKhan”, “we”, “us”, or “our”). Please read them carefully.

Eligibility

You must be eligible to enter into a binding contract to use MusiKhan. By using the Platform, you represent that you are not barred from using the Platform under any applicable laws – for example, you are not located in a country subject to export controls or other legal restrictions that would prevent your use of blockchain services. If you are using MusiKhan on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms, in which case “you” will refer to that entity. We may refuse access to the Platform (or any part of it) to any User at our sole discretion, especially if eligibility requirements are not met.

Account Registration

Using MusiKhan’s services may require creating an account or connecting a supported digital wallet or third-party account. Account Information: You agree to provide truthful, current, and complete information during registration. You are responsible for maintaining the confidentiality and security of your account credentials (including any private keys or login details). Account Security: Do not share your account or wallet credentials with anyone. If you suspect any unauthorized access to your account or wallet, you must notify us immediately. MusiKhan is not liable for any loss or damage arising from unauthorized use of your account. Multiple Accounts: You may not create multiple accounts to bypass any restrictions or gain unfair advantages. We reserve the right to suspend or terminate any account that we believe is in violation of these Terms or is otherwise used improperly or illegally.

LP Staking Requirements

MusiKhan’s core feature is that access to music streaming is provided in exchange for staking Liquidity Provider (“LP”) tokens. This means you may be required to lock a certain amount of specific cryptocurrency tokens in a designated liquidity pool or smart contract to gain or maintain access to MusiKhan’s content and features. The types of accepted LP tokens, the required staking amount, and the staking duration or conditions will be communicated through the Platform and may change from time to time. By staking your LP tokens, you acknowledge and agree to the following:

• Staking Process: Staking typically involves using an external blockchain protocol or decentralized exchange. You may need to connect a compatible crypto wallet and follow on-screen instructions to stake your tokens. All blockchain transactions (including staking and unstaking) are executed at your direction and require payment of network fees (e.g., gas fees). You are solely responsible for any such fees.

• Access to Content: Once the required LP tokens are staked and verified, MusiKhan will grant you access to specified music streaming content and features. If your staked balance falls below the required amount (for instance, if you unstake tokens or if their value drops below a threshold, if applicable), MusiKhan reserves the right to restrict or revoke your access to certain content until the requirement is again met.

• Rewards (if applicable): MusiKhan may offer incentives such as rewards or tokens (“Rewards”) for staking and engaging with the Platform (for example, listening to music in a “Tune-to-Earn” model). Such Rewards, if offered, are subject to separate rules or program terms which will be provided. We do not guarantee any particular reward or return on staking, and all reward programs are subject to change or termination at our discretion.

• Risk Acknowledgment: You understand that staking LP tokens involves inherent risks. The value of cryptocurrencies can be volatile, and there is no guarantee of any financial return. Additionally, blockchain smart contracts carry risks of bugs or vulnerabilities that could lead to partial or total loss of your staked tokens. MusiKhan is not responsible for any losses related to your decision to stake tokens, including losses due to smart contract failures, security breaches, hacking, inflation or devaluation of tokens, or other technical issues. You stake tokens at your own risk.

• No Investment Advice: Providing LP tokens for staking is not an investment in MusiKhan; it is a mechanism to access digital content. Nothing on the Platform constitutes financial or investment advice. You should conduct your own research and consider your risk tolerance before participating in any staking activity.

Music Streaming Access

MusiKhan provides a digital platform for streaming music content once you meet the staking requirements above. License to Use Content: When access is granted, MusiKhan and its licensors offer you a personal, limited, non-exclusive, non-transferable, revocable license to stream music and other media available on the Platform for your own personal, non-commercial entertainment use. All content is provided for streaming-only; unless explicitly allowed by the Platform, you are not permitted to download permanent copies of the music or other content. You agree not to reproduce, redistribute, sell, broadcast, publicly perform, or otherwise use the content in a manner not expressly permitted by these Terms.

Quality and Availability: We strive to provide a high-quality streaming experience, but we do not guarantee that any particular content will be available at any given time or that streaming will be uninterrupted or error-free. Content offerings may change without notice (for example, songs may be added or removed due to licensing agreements or other reasons). MusiKhan reserves the right to modify or discontinue any part of the streaming service or content catalog at its discretion.

Usage Rules: You must use the streaming service in compliance with these Terms and all applicable laws. You must not attempt to circumvent any technical measures we implement to secure content or enforce staking requirements (such as DRM or access controls). Using any software or techniques to capture or record streams, or to access content without an active required stake, is strictly prohibited. Your access to the content is conditional on your continued compliance with these Terms and may be suspended or terminated if you violate any Terms or if you no longer fulfill the staking criteria.

Intellectual Property Rights

All materials and content provided on MusiKhan – including but not limited to music tracks, audio recordings, lyrics, images, artwork, text, software, compilations, and the overall selection and arrangement of the Platform – are protected by intellectual property laws (such as copyright, trademark, and other proprietary rights). These materials are owned by MusiKhan, its affiliates, or third-party licensors (such as artists, record labels, or content rights holders) who have authorized their content to be available on the Platform.

MusiKhan’s Rights: MusiKhan and its licensors retain all rights, title, and interest in the Platform and its content. “MusiKhan” as well as all associated logos, trademarks, service marks, and trade names are the property of our company or our licensors. Nothing in these Terms grants you any ownership of these intellectual property rights. You are only granted the limited streaming license as described in the “Music Streaming Access” section above.

User Content: If you are allowed to submit any content on MusiKhan, such as comments, feedback, or other material (“User Content”), you retain any intellectual property rights you hold in that content. However, by submitting User Content, you grant MusiKhan a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and adapt your User Content for the operation, promotion, and improvement of the service. (For example, if you leave a comment or playlist publicly, you allow us to display it to other users.) You represent that you have the necessary rights to any User Content you provide and that such content does not infringe or violate the rights of any third party. We reserve the right to remove any User Content that violates these Terms or applicable law.

Restriction on Use: You agree not to copy, reproduce, distribute, publicly perform, or create derivative works from any content on the Platform except as explicitly permitted. You may not reverse-engineer, decompile, or disassemble any part of the Platform or its software, nor attempt to extract source code or algorithms, except to the limited extent allowed by applicable law (and then only with advance notice to us). If you infringe our or our licensors’ intellectual property rights, your rights under these Terms will terminate immediately and you may be subject to legal action.

Prohibited Conduct

When using MusiKhan, you agree to follow the rules and refrain from any prohibited conduct. You must not:

• Violate Laws or Rights: Use the Platform for any unlawful purpose or engage in any activity that violates any applicable law or regulation. This includes infringing any intellectual property or privacy rights of others. You must respect all copyrights, trademarks, and other rights in the content you access.

• Circumvent Staking or Security: Attempt to bypass or undermine the LP staking requirements or any security features of the Platform. For example, you must not try to hack, decrypt, or otherwise gain access to content or areas of the service without proper authorization or without meeting the staking criteria. Similarly, do not attempt to avoid or remove digital rights management (DRM) protections or watermarking on content.

• Unauthorized Sharing: Share, sell, rent, or sublicense your account or access to the Platform, or provide any other person with access to the content available to you. Your account is personal to you; giving others access (for instance, by streaming content in a public setting or broadcasting it on another service) without permission is prohibited.

• Harmful Activities: Upload, transmit, or introduce any material that is malicious or technologically harmful to the Platform, such as viruses, malware, worms, or trojan horses. You also must not engage in activities that disrupt or interfere with the operation or performance of MusiKhan or its related networks and services (e.g., a denial-of-service attack or excessive automated requests).

• Fraud and Misrepresentation: Impersonate any person or entity, or misrepresent your affiliation with any person or entity while using the service. Do not engage in fraudulent activities, such as using stolen funds or payment methods, or manipulating metrics (e.g., artificially inflating play counts or reward metrics by using bots or scripts).

• Harassment or Illegal Content: Use the Platform to transmit or store any content that is defamatory, harassing, threatening, obscene, or otherwise unlawful. Although MusiKhan is primarily for streaming provided music (not user-generated content), if there are any interactive features (like chat or comments), you must not post content that is abusive, hateful, or could encourage criminal conduct.

• Unauthorized Commercial Use: You may not exploit the Platform or content for commercial purposes not expressly permitted by MusiKhan. This means, for example, you cannot use MusiKhan’s content as background music for a commercial event, re-stream the music on your own platform for profit, or use the MusiKhan brand in marketing without our prior written consent.

If you engage in any of the above prohibited conduct (or any other conduct we determine to be harmful, unlawful, or in violation of the spirit of these Terms), MusiKhan may take action. This can include suspending or terminating your account, revoking access to content, freezing earned rewards, and/or taking legal action where appropriate. We also reserve the right to cooperate with law enforcement and disclose information necessary for legal compliance in the event of any suspected illegal activity.

Disclaimer

Use at Your Own Risk: MusiKhan and its services are provided on an “as is” and “as available” basis. While we endeavor to provide a great platform, we make no warranties or representations of any kind (express or implied) about the accuracy, reliability, completeness, or availability of the Platform or any content on it. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of title, non-infringement, merchantability, fitness for a particular purpose, and any warranties arising out of course of dealing or usage of trade. We cannot guarantee that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You are responsible for implementing sufficient security procedures (like up-to-date antivirus, and wallet security measures) to satisfy your requirements.

Blockchain and Content Disclaimers: You acknowledge that MusiKhan involves the use of blockchain technology and third-party systems. Transactions (such as staking) are irreversible and final on the blockchain. MusiKhan has no control over and makes no guarantees regarding the performance of any underlying blockchain network or smart contract. Additionally, any content provided comes from third-party licensors (artists, rights holders) and MusiKhan is not liable for any content that might be considered offensive or infringing if it was provided to us under misrepresentation. We may remove content that is reported to violate rights, but we are not responsible for content provided by third parties.

Limitation of Liability: To the maximum extent permitted by applicable law, MusiKhan, its parent company, affiliates, officers, employees, partners, and licensors will not be liable for: any indirect, incidental, special, consequential, exemplary, or punitive damages; or any loss of profits, revenues, goodwill, data, or use, or lost opportunity, or cost of procuring substitute services, in each case arising out of or related to your use of (or inability to use) the Platform or content, or these Terms, regardless of the theory of liability (contract, tort, negligence, strict liability, statutory or otherwise) and even if we have been advised of the possibility of such damages.

Modification of Terms

Updates to Terms: MusiKhan may modify or update these Terms of Service from time to time. If we make material changes, we will provide reasonable notice to users – for example, by posting the updated Terms on our website or platform and updating the “last updated” date, or by sending an email or notification through the service. In some cases, especially if required by law or if changes significantly affect your rights or obligations, we may provide at least 15 days’ advance notice.

Acceptance of Changes: By continuing to use MusiKhan after any revised Terms become effective, you are indicating that you agree to be bound by the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and (if applicable) may request to terminate your account or withdraw your staked tokens (subject to any conditions for unstaking).

Additional Policies: From time to time, we may also introduce or update other policies that govern specific aspects of the Platform (such as a Rewards Program Policy or Community Guidelines). We will notify users or post these as appropriate, and such policies are incorporated by reference into these Terms once issued. In case of any conflict between these Terms and any additional policy, these Terms will prevail unless the additional policy expressly states otherwise.
